No Doubt, the band is suing Activision over their likeness in the music video game Band Hero.  The filing was made years ago and a judge has now agreed to have a jury hear the case.

The band, particularly Gwen Stefani, is suing Activision because the game allows players to switch around the lead Avatar.  The song “Honky Tonk Women” performed by the Rolling Stones is in Band Hero and users can create,”an unauthorized performance by the Gwen Stefani avatar in a male voice boasting about having sex with prostitutes.”  The band, alleges, they were not informed of this feature that allowed their avatars perform other artist music when they signed the contract with Activision.

Activision is not taking this lawsuit lightly.  The company has revealed they did inform the band of the avatar switching and claims to have a video recording of the discussion.  This case was filled in 2009 and has been going on since then.
